This consultation paper sets out proposals for amending the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999 (SI 1999/293) in England, to take account of two related judgments of the European Court of Justice (ECJ). The judgments were issued on 4 May 2006 in cases C-290/03 (reference for a preliminary ruling in R v London Borough of Bromley ex parte Barker) and C-508/03 (Commission v UK).
